1. General Overview & Agreement
Welcome to the official website of PT Jangkar Sampuran Berkat (hereinafter referred to as "JSB", "the Company", "we", "us", or "our"). By accessing or utilizing our website (jangkarsampuranberkat.com) and our maritime shipping agency and logistics services, you agree to comply with and be bound by these Terms and Conditions.
If you do not agree to these terms, please refrain from using our website or engaging our services. These terms apply to all vessel owners, charterers, cargo managers, vendors, and website visitors.
2. Scope of Services
PT Jangkar Sampuran Berkat operates two core divisions across Indonesian ports:
- JSB Shipping Agency: Port agency services, husbandry, bunker supply, store & provision supply, underwater survey, manning agency, charterer agency, and Owner Protective Agency (OPA).
- JSB Logistics: Sea & air freight forwarding, customs clearance & brokerage, supply chain solutions, inland trucking, and cargo dooring.
All service agreements, agency nominations, and operational instructions are subject to standard international maritime practices, Indonesian port authority regulations, and specific bilateral service contracts signed between JSB and the Client.
3. Vessel Nominations & Disbursement Accounts (FDA/PDA)
3.1 Proforma Disbursement Accounts (PDA): Estimated costs provided in PDAs are calculated based on published port tariffs, official dues, and anticipated operational requirements at the time of quotation. PDAs are subject to final adjustment based on actual port invoices and services rendered.
3.2 Pre-funding & Remittance: Unless otherwise agreed in writing, JSB reserves the right to request advance remittance of funds prior to vessel arrival or service execution to cover port dues, pilotage, tugboat fees, and customs duties.
3.3 Final Disbursement Accounts (FDA): FDAs with supporting vouchers and official receipts will be issued promptly after vessel departure. Payment of any outstanding balances is due within 14 calendar days from the invoice date.
4. Limitation of Liability
While JSB exercises utmost care and professionalism ("Ensure Our Customers Has a Nice Sleep"), the Company acts as an agent only for and on behalf of the vessel owner, charterer, or principal. JSB shall not be held liable for:
- Delays caused by port authority congestion, weather conditions, force majeure, or statutory inspections.
- Loss or damage to cargo or vessels unless caused by direct gross negligence or willful misconduct of JSB employees.
- Indirect, consequential, or punitive damages arising from third-party vendor performance (e.g., pilotage, tugs, stevedores).
5. Governing Law & Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the **Republic of Indonesia**. Any disputes arising from or in connection with our services shall be submitted to the exclusive jurisdiction of the District Court of Jakarta, Indonesia, or resolved amicably through maritime arbitration.
